Since Donald Trump’s inauguration many executive orders have been signed. An order called “Protecting the American People Against Invasion” was signed to take away sanctuary cities and places to help enforce mass deportation.
An Immigration and Customs Enforcement agent must present a judicial warrant signed by a judge to enter any non-public area of the school, or question or remove any student from their classroom.
The order states that “It ensures that Federal funds to states and localities will not be used to support “sanctuary” policies or assist illegal immigration,” the white house fact sheet said.
Sanctuaries are cities and places that are safe for migrants. Sanctuary buildings included Schools, Hospitals, and Churches. These buildings ensured that migrants were protected from ICE while inside the building. ICE was legally not able to enter sanctuary buildings to detain migrants. Since the new order was passed ICE is now able to enter any building to detain migrants. ICE with a judicial warrant is able to enter school or get information from administration to find migrant students or staff and detain them.
“But just because ICE can now show up at a school for an enforcement action, teachers and school administrators still have the right and responsibility to protect their students under the U.S. Constitution and federal and state law.” Keith Armstrong, Fellowship Attorney, Immigrants’ Rights, Legal said.
“With this Executive Order, President Trump is ensuring taxpayer resources are used to protect the interests of American citizens, not illegal aliens,” the white house fact sheet said.
Students and staff should learn their rights about being detained by ICE. Staff and Students need to know what a signed judicial warrant looks like to allow ICE into non-public areas of the school.
